It has been reported today that the government, under the direction of the troika, will attempt to change the Land and Conveyancing Law Reform Act 2009, the Act that currently makes it more difficult for banks to gain repossession orders against mortgage holders. The government refers to this as a “loophole” to make it appear to the people that this was some sort of mistake or oversight, In reality this is Irish law as it stands, and thankfully it offers some small amount of equity to homeowners in dispute with banks, and forces the banks to prove their case by other means. However the bankers now wish to change our laws to further benefit themselves as they feel it gives too much protection.
So now we see the embarrassing spectacle of European bankers telling the obedient Irish government to change Irish laws to make it easier for them to win in court against Irish people. The same Irish people who have already been forced to bail out the bondholders and to refinance these same banks. It would seem that the bankers have an insatiable appetite to impoverish as many of the Irish people as possible.
What kind of a government changes laws to benefit corporations over the sovereign people who it is elected to represent? If this is how the country is to be run then why have laws and courts at all? Why not take it to the next step and just allow a bank to write to the home owner in a dispute and tell them that the bank have decided to take their home because it would save the homeowner a lot of money in legal costs in the long run? This is essentially where we are heading if banks are allowed to dictate Irish law.
